4. Data Retention

Personal data is retained only for as long as necessary to fulfill the purposes for which it was collected. Contact form submissions are retained for a maximum of 24 months from the date of last communication. After this period, data is securely deleted or anonymized.

Under the General Data Protection Regulation, you have the following rights regarding your personal data:

6. Data Security

AxiometricLabs implements appropriate technical and organizational measures to protect personal data against unauthorized access, alteration, disclosure, or destruction. These measures include encrypted data transmission (TLS/SSL), access controls, and regular security assessments in compliance with Article 32 GDPR.

7. International Data Transfers

We do not transfer personal data outside the European Economic Area (EEA) unless appropriate safeguards are in place, such as Standard Contractual Clauses (SCCs) approved by the European Commission under Article 46(2)(c) GDPR.

Refund Policy

1. Scope

This Refund Policy applies to all services provided by AxiometricLabs, registered at Calle Berástegui 54, Piso 2 A, Madrid, Spain. It governs the conditions under which refunds may be issued for digital services rendered.

2. Milestone-Based Refund Structure

All projects operated by AxiometricLabs follow a milestone-based delivery structure. Refunds are evaluated proportionally based on the completion status of project milestones:

  • Pre-Initiation Cancellation — If a project is cancelled before any work has commenced, a full refund of any advance payment will be issued within 14 business days.
  • Partial Completion — If a project is cancelled after work has commenced but before final delivery, a proportional refund will be calculated based on the percentage of completed milestones versus total project scope.
  • Post-Delivery — Once a project has been delivered and accepted by the client, no refunds will be issued. Delivered digital assets are non-refundable.

3. Refund Request Process

To request a refund, you must submit a written request to [email protected] within 14 days of the relevant invoice date. Include your project identifier, invoice number, and a description of the grounds for your refund request. We will respond within 5 business days.

4. Non-Refundable Items

  • Custom design work already approved and delivered in any format
  • Third-party costs incurred on behalf of the client (stock assets, domain registrations, hosting fees)
  • Services rendered under a fixed-price agreement where delivery has been completed
  • Consultation or advisory sessions that have been conducted

5. Dispute Resolution

In the event of a refund dispute, AxiometricLabs agrees to engage in good-faith mediation before pursuing any formal dispute resolution. Disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain, in accordance with applicable Spanish consumer protection legislation.

6. Consumer Rights

This Refund Policy does not limit or exclude your statutory rights under Spanish consumer protection law (Ley General para la Defensa de los Consumidores y Usuarios) or the EU Consumer Rights Directive (2011/83/EU). You retain all mandatory statutory rights regardless of this policy.

Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by AxiometricLabs, registered at Calle Berástegui 54, Piso 2 A, Madrid, Spain, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

2. Service Description

AxiometricLabs provides digital design, visual storytelling, and web interface engineering services. All services are delivered as described in the individual project proposals andStatements of Work (SOW) agreed upon between the parties.

3. Project Scope and Changes

The scope of each project is defined in the agreed-upon proposal or Statement of Work. Any changes to the project scope must be documented in writing and may result in additional fees and timeline adjustments. Scope changes require mutual written agreement before implementation.

4. Payment Terms

Payments are due as specified in the project proposal or invoice. Standard payment terms are 50% upfront upon project initiation and 50% upon delivery, unless otherwise agreed in writing. Late payments may incur a fee of 1.5% per month on the outstanding balance, in accordance with applicable Spanish commercial law.

5. Intellectual Property

Upon full payment, all intellectual property rights for the delivered work product are transferred to the client. AxiometricLabs retains the right to display completed work in its portfolio and marketing materials unless explicitly restricted in the project agreement. Pre-existing intellectual property, frameworks, and tools used in the creation process remain the property of AxiometricLabs.

6. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of the engagement. This obligation survives the termination of the service agreement for a period of 24 months.

7. Limitation of Liability

To the maximum extent permitted by applicable law, AxiometricLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total aggregate liability shall not exceed the total amount paid by the client for the specific service giving rise to the claim.

8. Termination

Either party may terminate a service agreement with 15 days' written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. All deliverables completed and paid for will be transferred to the client upon termination.

9. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from causes beyond reasonable control, including but not limited to natural disasters, pandemics, government actions, or infrastructure failures.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Spain. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.

11. Changes to These Terms

AxiometricLabs reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to this website. Your continued use of our services after any changes constitutes acceptance of the updated terms.
